Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ClaireCam mobile application, the Claire Sense dashcam ecosystem, and related services (collectively, the "Services") provided by Claire Sense Inc. ("Claire Sense," "we," "us," or "our").

By downloading, installing, or using our Services, you agree to be bound by these Terms and to comply with all applicable local, provincial, national, and international laws and regulations — including privacy and data protection laws in your jurisdiction. If you do not agree, do not use the Services.

Definitions

Capitalized terms used in these Terms have the meanings defined in our Privacy Policy. Key terms include:

• "Claire Sense," "we," "us," or "our" — Claire Sense Inc., a corporation incorporated under the laws of Alberta, Canada.
• "ClaireCam" or "the App" — the ClaireCam mobile application.
• "Services" — ClaireCam, the dashcam ecosystem, and all related services provided by Claire Sense.
• "Recording" — the continuous video and audio captured by ClaireCam during a recording session, stored locally on your device.
• "Clip" — a discrete segment of a Recording that you select, lock (mark for preservation to prevent automatic deletion by loop recording), or export for sharing or upload.
• "Telemetry Data" — structured data logged alongside Recordings, including speed, g-force, GPS coordinates, heading, altitude, and driving events.
• "Sensor Data" — accelerometer readings used for driver scoring and event detection.
• "Hazard Report" — a user-submitted report of a road hazard.
• "Hazard Alert" — a notification delivered to users about a nearby hazard, generated from Hazard Reports submitted by the community.
• "Anonymized Data" — data irreversibly altered so it cannot identify a specific individual. See the Privacy Policy for the full definition.
• "Aggregated Data" — data combined across multiple users, trips, or areas and presented only in statistical or summary form.
• "De-Identified Data" — data from which direct personal identifiers have been removed but which has not been irreversibly anonymized.
• "Personal Information" — information that identifies, relates to, or could reasonably be linked to an identified or identifiable individual.

1. Eligibility

You must be at least 16 years of age to use the Services. By using the Services, you represent that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.

2. Acceptable Use

You agree to use the Services only for lawful purposes and in compliance with all applicable laws, including traffic and privacy laws in your jurisdiction. You agree NOT to:

• Use the Services while driving in a manner that distracts you or endangers safety.
• Record, share, or distribute Recordings or audio in violation of applicable privacy or surveillance laws.
• Submit false or misleading Hazard Reports or other community data.
• Attempt to reverse-engineer, decompile, or extract source code from the App.
• Use the Services to harass, stalk, or invade the privacy of any person.
• Circumvent, disable, or interfere with any security features of the Services.
• Use automated scripts or bots to access the Services.

3. Recording & Privacy Laws

You are solely responsible for complying with all applicable recording, surveillance, and privacy laws in your jurisdiction. Laws regarding dashcam recording, audio capture, and sharing of Recordings vary significantly by country, province/state, and municipality. Before using the recording features:

• Verify that dashcam recording is legal in your jurisdiction.
• Determine whether audio recording requires consent from all parties in your region.
• Understand any restrictions on where you may record (e.g., private property).
• Comply with data protection regulations when sharing or uploading Clips.

Claire Sense provides the mute feature to disable audio recording. We strongly recommend enabling it in jurisdictions that require all-party consent.

4. Driver Safety, Cautious Driving & Assumption of Risk

The driver scoring system, speed limit display, enforcement camera warnings, Hazard Reports, and Hazard Alerts are provided for informational purposes only. These features:

• Are NOT a substitute for attentive, responsible driving or proper situational awareness.
• May contain inaccuracies due to GPS drift, outdated map data, user reporting errors, or incomplete coverage.
• Should NOT be relied upon as the sole source of speed limit, traffic condition, or road hazard information.
• Do not guarantee the detection or warning of all enforcement cameras, hazards, obstacles, or speed zones.

Road Information Prevails: Information displayed on road signs, traffic signals, posted speed limits, and instructions from law enforcement or emergency personnel always take precedence over any information provided by the Services. In the event of a discrepancy, you must follow real-world road conditions and legal directives.

Cautious Driving & Hands-Free Requirement: Interacting with the App, viewing non-essential screens, or submitting Hazard Reports non-verbally while operating a moving vehicle is strictly prohibited. You agree that any manual or screen-based interaction with the Services must occur ONLY when your vehicle is safely stopped in a location permitted by law, or when performed by a passenger who is not operating the vehicle.

Sole Responsibility for Distracted Driving: You remain fully and exclusively responsible for complying with all applicable motor vehicle, hands-free, and distracted driving laws. Claire Sense Inc. disclaims all liability, and you expressly release and hold harmless Claire Sense Inc. from any claims, fines, traffic violations, accidents, collisions, bodily injury, property damage, or death arising from or related to distracted driving, driver inattention, or your interaction with the Services while operating a vehicle.

5. Intellectual Property

The Services, including all software, designs, logos, trademarks, and content, are owned by Claire Sense Inc. and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes.

Recordings and Telemetry Data captured by you remain your property. By using the Services, you grant Claire Sense Inc. a non-exclusive, worldwide, royalty-free license to collect, store, process, anonymize, aggregate, and use data generated through your use of the Services — including Telemetry Data, GPS trajectories, Sensor Data, and driving behavior data — for the purposes described in Section 6 below and in our Privacy Policy.

6. Uploaded Data, Cloud Storage & Consent to Processing

We provide cloud storage space for the purpose of enabling you to share Clips and hazard data with recipients you designate. Storage is provided solely for sharing purposes and is subject to your subscription plan limits.

By uploading Clips or hazard data to our Services, you agree that:

• The uploaded data may be processed and Anonymized by Claire Sense to provide and improve localized services — including Hazard Alerts, road condition monitoring, speed limit verification, and other safety features relevant to the geographic area of the upload.
• All processing is performed in accordance with applicable local privacy laws and our Privacy Policy.
• Anonymized and Aggregated Data derived from uploads may be used for the commercial purposes described in Section 7 below.

7. Data Licensing & Commercial Use

Claire Sense Inc. may anonymize, aggregate, and de-identify data derived from your use of the Services and license or sell such data to third parties, including but not limited to:

• Autonomous vehicle and advanced driver-assistance system (ADAS) developers — for training perception models, validating safety systems, and improving road scene understanding.
• Insurance companies — for Anonymized driving behavior analytics, risk modeling, and actuarial analysis.
• Municipalities and government agencies — for road asset management, infrastructure condition monitoring, and traffic safety analysis.
• Mapping and navigation companies — for road network updates, speed limit verification, and point-of-interest data.

All commercially shared data is Anonymized and Aggregated before it leaves our systems. It cannot be used to identify you individually. Your Recordings are never sold or shared without your explicit consent. Uploaded Clips may be temporarily held in a secure processing queue before anonymization is applied. Faces, license plates, and other personally identifiable elements are removed or obscured before any data is permanently stored or made available to third parties. All commercial data use complies with applicable local privacy laws.

8. Subscriptions & Payments

Certain features may require a paid subscription. Subscription terms:

• Billing Platform: Subscriptions are billed through the Apple App Store or Google Play Store depending on your device platform. The applicable app store's terms, billing practices, payment methods, and refund policies apply.
• Automatic Renewal: Subscriptions auto-renew automatically at the end of each billing cycle unless cancelled at least 24 hours prior to the end of the current subscription period through your Apple ID or Google Play account settings.
• Price Adjustments: We reserve the right to change subscription pricing with 30 days' advance notice. Notice will be posted on our website and/or within the App.
• Free Features: Core free tier features (including basic dashcam recording and local telemetry logging) remain available without a paid subscription.

9. Community Features & Hazard Reporting Protocols

If you use community features (such as submitting Hazard Reports, confirming Hazard Alerts, or enabling live trip sharing), you agree and acknowledge that:

• Safety-First Reporting Protocol: You will NOT create or confirm Hazard Reports non-verbally or via manual touch interactions while operating a moving vehicle. Manual hazard submissions or confirmations may ONLY be performed when the vehicle is legally and safely stopped, or by a passenger who is not driving.
• Sole Responsibility & Liability Release: You are strictly liable for your own conduct while using community features. You acknowledge that attempting to submit or verify road hazards while driving creates severe distracted driving risks, and you assume all liability for any accidents, injuries, fines, or damages resulting therefrom.
• Truthful & Good-Faith Submissions: You will submit only truthful, accurate, and good-faith Hazard Reports, and will not abuse, flood, or manipulate the community reporting system with false data.
• User-Generated Content Disclaimer: Community-reported hazard data is crowdsourced from app users and third parties. Claire Sense Inc. does not independently verify each report in real time, and makes no warranty regarding the accuracy, completeness, or timeliness of Hazard Alerts.
• Live Trip Sharing Awareness: Live trip sharing streams your real-time location and telemetry to anyone possessing the generated share link. You are solely responsible for managing who receives your share links.

10. Data Connectivity & Costs

Certain features of the Services — including speed limit lookups, enforcement camera warnings, Hazard Alert polling, and live trip sharing — require an active internet connection. The internet connection and any associated charges (e.g., mobile data expenses) incurred by your use of the Services are your exclusive responsibility and made solely at your expense.

11. App Store & Device Platform Clauses (Apple & Google)

Apple Device Clause: If you use the Services on an Apple device, you agree and acknowledge that:

• Apple, Inc. bears no duties or obligations to you under these Terms, including any obligation to furnish you with Service maintenance and support.
• You will have no claims, and you waive any and all rights and causes of action against Apple with respect to the Services or these Terms.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms.

Android / Google Play Device Clause: If you use the Services on an Android device or download the App via Google Play, you agree and acknowledge that:

• These Terms are concluded solely between you and Claire Sense Inc., and not with Google LLC or its affiliates ("Google").
• Claire Sense Inc. is solely responsible for the App, its content, maintenance, and support. Google has no obligation or duty to furnish any maintenance or support services for the App.
• To the maximum extent permitted by applicable law, Google has no warranty obligation whatsoever with respect to the App, and is not responsible for addressing any claims by you or third parties relating to the App or your use thereof.
• Google and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Google will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

12. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Services will be uninterrupted, error-free, or secure.
• Speed limit, enforcement camera, or hazard data will be accurate or complete.
• The driver score reflects an objective or legally recognized measure of driving safety.
• Recordings will be preserved in all circumstances (e.g., app crashes, storage failures).

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAIRE SENSE INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

Our total aggregate liability for any claims arising from these Terms or the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Claire Sense Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, violation of these Terms, or violation of any law or third-party rights.

15. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services ceases immediately.

16. Governing Law & Local Compliance

These Terms are governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Alberta, Canada.

Notwithstanding the foregoing, nothing in these Terms limits your rights under mandatory local privacy or consumer protection laws that cannot be waived by contract. Where local law provides you with additional protections, those protections apply.

17. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App and on our website, with an updated "Last Updated" date. Your continued use of the Services after changes constitutes acceptance of the updated Terms.
